Following the submissions of national parliaments, stating that the proposed revision of the Posting of Workers Directive did not meet subsidiarity and proportionality requirements, the Commission is now obliged, under the 'yellow card' procedure, to review its proposal and publish a decision on whether to maintain, amend or withdraw it. Responding to this development the president of the Socialists and Democrats Group, Gianni Pittella, said:

"The S&D Group calls on the EU Commission to maintain its proposal, despite the 'yellow card' procedure triggered by some Member States' Parliaments. This proposal must neither be weakened nor withdrawn. This is about the thousands of posted workers whose fundamental rights can only be defended by a European solution to this issue.

"The revision of the Posting of Workers Directive is fundamental in order to protect posted workers, to safeguard fair competition and ensure equal pay for equal work at the same place."
